Safe Havens Live-In provides professional home care services for seniors and individuals requiring assistance with daily living activities. Our Services include, but are not limited to:

  • Live-in care services (24/7 care in the client's home)
  • Respite care services (temporary care for family caregivers)
  • Personal care assistance (bathing, dressing, grooming, mobility support)
  • Companionship services (social interaction and emotional support)
  • Housekeeping services (cleaning, laundry, meal preparation)
  • Medical escort services (transportation to medical appointments)

All Services are provided by trained, qualified, and screened caregivers. We reserve the right to modify, suspend, or discontinue any Service at any time without prior notice.

3. Service Agreements

To receive our Services, you must enter into a written service agreement that specifies:

  • The specific Services to be provided
  • Service schedule and duration
  • Pricing and payment terms
  • Care plan details and requirements
  • Cancellation and termination policies
  • Other terms specific to your care needs

The service agreement, together with these Terms, constitutes the complete agreement between you and Safe Havens Live-In. In case of conflict, the service agreement will prevail for service-specific terms.

4. User Obligations and Responsibilities

4.1 Accurate Information

You agree to provide accurate, complete, and current information when using our Website or Services. You must promptly update any information that becomes inaccurate or incomplete.

4.2 Safe Environment

You are responsible for providing a safe environment for our caregivers. You must disclose any safety hazards, dangerous conditions, or other relevant information that may affect caregiver safety or service delivery.

4.3 Compliance with Laws

You agree to comply with all applicable laws and regulations when using our Services. You must not use our Services for any illegal or unauthorized purpose.

4.4 Respectful Conduct

You agree to treat our caregivers and staff with respect and dignity. Abusive, threatening, or inappropriate behavior may result in immediate termination of Services.

4.5 Website Usage

When using our Website, you agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Website or Services

5. Payment Terms

5.1 Pricing

Service pricing is as specified in your service agreement. Prices are quoted in Canadian dollars and are subject to change with at least 30 days' prior written notice. All prices exclude applicable taxes, which will be added to your invoice.

5.2 Payment Methods

We accept payment by credit card, debit card, bank transfer, or other methods as agreed upon in your service agreement. Payment terms are specified in your service agreement, typically requiring payment within 15-30 days of invoice date.

5.3 Late Payments

If payment is not received by the due date, we reserve the right to:

  • Charge late fees as specified in your service agreement
  • Suspend or terminate Services until payment is received
  • Engage a collection agency or pursue legal action
  • Report to credit bureaus if applicable

5.4 Refunds

Refund policies are specified in your service agreement. Generally, refunds are not provided for Services already rendered, except as required by law or as specified in your agreement.

6. Cancellation and Termination

6.1 Cancellation by Client

You may cancel Services by providing written notice as specified in your service agreement. Cancellation fees may apply as set forth in your agreement. Emergency or short-notice cancellations may be subject to additional charges.

6.2 Termination by Safe Havens Live-In

We may terminate Services immediately if:

  • You breach these Terms or your service agreement
  • Payment is not received when due
  • You engage in abusive or inappropriate behavior
  • The care environment becomes unsafe for our caregivers
  • We determine that we cannot provide appropriate care
  • Required by law or regulatory authorities

6.3 Effect of Termination

Upon termination, all outstanding fees and charges become immediately due. We will provide reasonable notice when possible to allow for care transition arrangements.

7. Caregiver Assignment and Substitution

We reserve the right to assign, reassign, or substitute caregivers as needed to ensure continuity of care. We will attempt to provide consistent caregiver assignments when possible, but cannot guarantee that the same caregiver will be available at all times. We will provide qualified substitute caregivers when the primary caregiver is unavailable.

8. Limitation of Liability

To the maximum extent permitted by law, Safe Havens Live-In, its directors, officers, employees, agents, and caregivers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with our Services or Website.

Our total liability for any claims arising from or related to our Services shall not exceed the total amount paid by you for Services in the 12 months preceding the claim.

We are not liable for any damages resulting from:

  • Acts or omissions of third parties (e.g., healthcare providers, emergency services)
  • Natural disasters, accidents, or events beyond our reasonable control
  • Your failure to provide accurate information or a safe environment
  • Your non-compliance with care plans or medical advice

9. Insurance and Coverage

We maintain professional liability insurance and general liability insurance as required by law. However, we are not responsible for:

  • Medical expenses or healthcare costs (covered by your insurance or government programs)
  • Property damage not caused by our negligence
  • Personal injury or loss not caused by our negligence

You are responsible for maintaining appropriate insurance coverage for your property and personal liability.

10. Intellectual Property

All content on our Website, including text, graphics, logos, images, software, and other materials, is the property of Safe Havens Live-In or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or use any content from our Website without our prior written consent.

11. Dispute Resolution

11.1 Informal Resolution

11.2 Mediation

If informal resolution is unsuccessful, disputes may be resolved through mediation by a mutually agreed-upon mediator. Mediation costs will be shared equally unless otherwise agreed.

These Terms are governed by the laws of the Province of Ontario, Canada. Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Ontario, and you consent to the jurisdiction of such courts.

12. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, labor strikes, or other force majeure events.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Waivers must be in writing and signed by us.

15. Entire Agreement

These Terms, together with your service agreement and our Privacy Policy, constitute the entire agreement between you and Safe Havens Live-In regarding the use of our Website and Services, and supersede all prior agreements and understandings.
